VA Entitlement When You Sell, Keep or Rent a Home

When entitlement comes back after a sale, what stays in use if you keep or rent the home, and the 2026 county math.

VA ENTITLEMENT · NOVEMBER 2026

Your VA entitlement follows the loan, not the house keys. Sell the home and pay the loan off, and the entitlement it used can be restored; keep it, even as a rental, and that entitlement stays in use while the next purchase draws on what remains. This page sets out VA.gov’s rules for each path and works the 2026 San Diego County numbers.

Deciding between selling and keeping? The Home Strategy Quiz is four questions, and Rudy follows up with a plan for both homes.

When entitlement comes back

VA.gov’s eligibility page lists three conditions, and at least one must be true (updated September 22, 2026):

  • You have sold the home you bought with the prior VA loan and paid that loan in full.
  • A qualified Veteran-transferee assumes the loan and substitutes their entitlement for the same amount used originally.
  • You repaid the prior loan in full but have not sold the home bought with it (only once). See the one-time restoration.

If none fits, VA.gov adds that you may still have remaining entitlement to buy or refinance another home, which is the math further down this page.

How to ask VA for it

Restoration is requested, not automatic. VA.gov lists three ways: request a COE with an entitlement restoration online, ask your lender to submit the request online, or mail VA Form 26-1880 to the address on the form; VA.gov notes that mail requests may take longer. VA.gov gives no processing time, so plan with your lender on when to ask.

If you sell

Once the home is sold and the loan is paid in full, the first condition is met. Buying again before that closing is still possible: the old loan keeps its entitlement until payoff, so the new loan uses what remains. The table below shows how much that is at the 2026 San Diego County limit. The PCS Seller Countdown lays out the dates if orders set the timing.

If a buyer takes over your loan

A VA loan can be assumed. When the buyer is a qualified Veteran who substitutes the same amount of entitlement, yours can be restored. Otherwise your entitlement stays with the loan, though you may still have some remaining. The application is VA Form 26-6381, Application for Assumption Approval and/or Release from Personal Liability to the Government on a Home Loan (revision January 2024). Your servicer and VA decide, so ask your servicer early.

If you keep it or rent it out

Keeping the home keeps its entitlement in use until the loan is paid off. The next home bought with a VA loan has to be one you live in: VA.gov’s purchase-loan page says “You will live in the home you’re buying with the loan”. How rent from the first home counts toward the next loan is a lender question, so ask early.

Using the benefit a second time usually carries the subsequent-use funding fee: 3.3% with less than 5% down, 1.5% with 5% or more, and 1.25% with 10% or more (VA.gov). The VA funding fee calculator shows the dollars.

What remains at the 2026 San Diego County limit

For a loan above $144,000, VA guarantees up to 25% of the loan amount, so these rows estimate the entitlement in use as 25% of the original loan. At the $1,104,000 limit, 25% is $276,000. Your COE’s Entitlement Charged figure is the exact number; these rows estimate it from the original loan.

Remaining entitlement at the 2026 San Diego County limit ($1,104,000), estimated from the original loan
Original loanEntitlement in use (25% estimate)Remaining at $1,104,000 (25% = $276,000)Largest loan most lenders would make with no down payment (× 4)
$400,000$100,000$176,000$704,000
$500,000$125,000$151,000$604,000
$650,000$162,500$113,500$454,000

$1,000,000$250,000$26,000$104,000

In Orange County, where San Clemente is, the 2026 limit is $1,249,125, so each row would leave $36,281 more.

The owner side

Deciding whether to rent the home or sell it is its own question. Our sister site has a rent-or-sell guide for PCS moves and a tax timeline for a rented home.

Common questions

Do I get my entitlement back automatically when I sell?

No. Once the home is sold and the loan paid in full, you request the restoration: online, through your lender, or with VA Form 26-1880 by mail (VA.gov).

Can I buy again before my first home sells?

Often, yes, using the entitlement that remains while the first loan is still open. The table above estimates it; your lender confirms it from your COE.

Can I have two VA loans at the same time?

It is possible when enough entitlement remains, and the lender approves the loan. The next home has to be one you will live in (VA.gov).

What if a non-Veteran buyer assumes my loan?

Then your entitlement stays with that loan. VA.gov says you may still have remaining entitlement for another purchase; the calculator shows how much.

What if no entitlement remains?

VA.gov says most lenders look for your entitlement, a down payment or both to cover at least 25% of the loan, so a down payment would carry more of that share. Your lender decides how it applies.
